Documents Sexed-Up For Dramatic Puroposes

Oh, no… What we had here in the past ten-or-so days was almost worthy of an Austin Powers adventure. Guess who plays Dr. Evil

Remember Operation North? When twenty years after the deed President Danilo Türk awarded a medal to the last socialist interior minister Tomaž Ertl for preventing a Milošević-induced mass rally in Ljubljana in 1989 aimed at overthrowing the reform Communist leadership and installing a pro-Serb hard-liners at the helm of the country? Slightly more than a year ago giving a medal to Ertl (who was, among other things, head of the state secret police) made Janez Janša‘s SDS go apeshit and move to impeach president Türk on the grounds of supporting human rights violations. Janša’s move failed spectacularly but in the whirlwind of half-truths, accusations and conjectures that were the “impeachment case”, a set of questions stood out like a sore thumb: “What was Türk’s connection to Ertl and what did the President know of Ertl’s involvement in acts of international terrorism”

Shaggadelic, baby, yeah!

Fast forward eleven months and SDS starts making noises about how archives of the Slovene branch of SDV (Yugoslav secret service) still remain inaccessible and how this is most unacceptable, undemocratic and (oy vey!) unlawful. It goes on to say that SOVA, the current Slovene secret service, still prevents access to archives of former SDV and by that prevents parliamentary and public oversight of the intelligence services (the pretext being that Igor Omeza, a man of colourful past and high-profile past was denied access to the archives when supposedly researching a story). This apparently pained Janša so much, that he discussed the issue even in a debate on WikiLeaks, where he – in the presence of the new US Ambassador to Slovenia Joseph A. Mussomeli – made a quick argument against releasing the US State Departament cables but then went on a long tirade on why classified SDV archives must be made public in all their ignomy.

And then, a year almost to the day after Türk awarded Ertl with that infamous medal, SDS spectacularly “discovers” documents which supposedly prove that President Türk had detailed knowledge of the 1979 Velikovec (Völkermarkt) bombing in Austrian Carynthia in which three people were injured and which today is widely accepted to have been orchestrated by Slovene branch of SDV or at the very least cooked up by more rabid elements within the service. SDS claimed this directly linked Türk to acts of international terrorism as well as put him firmly in the circle of communist intelligence services. And what worse than an (albeit indirect) accusation that an incumbent president collaborated with communist secrecy service, by extension making either a spy or a snitch.

Enter Exhibit A

President Türk denied any prior or detailed knowledge of the Velikovec bombing. In what was an unusally strong-worded denial (Slovenian only) he bluntly accused Janša’s SDS of manipulation and deceit. Namely, the core of SDS’ case was a diplomatic cable from Yugoslav embassy in Vienna dated almost ten months after the bombing which was a compilation of official an unofficial Austrian responses as well as clippings from Austrian media in relation to the bombing. Recipients of the document included top Party brass and heads of other relevant institutions and committees, including one Danilo Türk, president of the SZDL committee for issues of minorities and diaspora.

At this point it should be noted that in 1979 Danilo Türk was a 26-year-old freshly minted law school graduate who just returned from serving in the army and landed his first job at SZDL (Socialist Union of Working People). The latter was a sort of all-encompassing umbrella organisation for groups and activities which were not strictly sanctioned by the Party, but were needed to be a part of the system to a) maintain the illusion of plurality and b) for the party to keep tabs on them. SZDL was designed to be the intermediary between the Party and the people and as a result, people working with or for SZDL could get away with a whole lot more than those working for the Party. Just to prove my point: the documents which started the JBTZ affair and ultimately began the final push for Slovenian independce were “acquired” by Igor Bavčar (today of Istrabenz infamy) in 1988 while he was working for that same SZDL.

Enter Exibit B

Anyways. Türk denies it and SDS immediately shoots back saying that not only is the President lying but also that it has in its possession a document which proves that Danilo Türk and SDV chief Tomaž Ertl (the one with the medal) go way back and did not meet face-to-face only last year as Türk had claimed during the impeachment proceedings. To back up their claim, they produced another document, a letter by interior secretary Tomaž Ertl from 1982 in which the latter informs the former that the Interior Secretariat is replacing its member of the Türk’s committee.

SDS of course failed to prove either one of their claims. Rather than proving that Türk was a member of the inner circle of the Party/SDV circles, the first set documents proves only that Türk was “privy” to diplomatic cables on the issue of Velikovec ten months after the attack and that information in that particular cable was stale, to say the least. Even more. The list of recipients of the said cable include not only the top Party officials, but people across the institutional spectrum of the socialist system (the Assembly, the SZDL, various committees) which points to the fact that the cable is a cleaned-up “civilian” version of intelligence collected (if there ever was any). In other words, it’s harmless. Secondly, claiming that Türk and Ertl go back thirty years (and again by conjecture trying to establish a link between the President and the inner circles of the SDV) by means of producing a bureaucratic notification is akin to fans claiming to be buddies with Bono of U2 on account of having his autograph. An exaggeration of biblical proportions, that is.

The plot thickens

However, things got even more interesting. First it transpired that SDV documents were sealed by the government of Janez Janša. It turned out to be a classic. First, Janša’s right-wing coalition passed a law transferring all SDV documents to the state archives and aimed at declassifying them. Only then did a special committee take a look at the archives and apparently discovered that some of them are smoking hot. As a result SOVA (Slovene secret service) reclassified parts of documents and Janša’s government set a new release date for them, forty years from now. So, rather than whining about how this government is unlawfully hiding the archives (and at the same time condemning Wikileaks for releasing some other archives), Janša and his party would be better off keeping their mouth shut.

However, this is obviously too much to ask. Releasing supposedly damaging documents has been Janša’s modus operandi for the past 25 years. Indeed, he was sent to prison by the federal army in 1988 for being in possession of a secret army document and after a glorious period during the war of independence in 1991 things only got worse. In 1994, during an attempted coup d’etat, army intelligence service loyal to Janša tried to plant forged documents and use them as pretext to topple the government. The plan backfired and the whole thing ended with Janša’s dismissal as defence minister. After that he made a career of sifting through old archives and publishing them in volumes on end, each and every time claiming to have shed new light on the role of key players of Slovenian independence. Although the documents were either declassified or have at the very least been in the public domain for a very long time, Janša always interpreted them in a way that extolled his role in achieving the independence and portrayed him as a victim of SDV, at the same time diminishing role of others key players, depending on who was his primary enemy at any given time. This time around this appears to be President Türk, who admittedly has little or no direct involvement in achieving the independence but is apparently enough of a problem for Janša to be discredited at all costs. Even if the released documents are forgeries.

Yes. It turns out that the first set of documents wasn’t actually a single set of documents but rather two different batches, sent to two different lists of addressees at two different dates. Indeed, one set (with more details in it) was not addressed to Türk but rather to his predecessor in the SZDL committee. So, in order to implicate Türk in a spy-ring-scandal, SDS published forgeries. If you want to be really lenient, you can call it a document that was “sexed-up for dramatic purposes”. At any rate, the documents thus became irrelevant, while Janša was once again caught lying.

But… Why?

This fuck-up-uncovered might also explain Türk’s strong reaction to Janša’s initial claims. Rumours were circulating for the past few days that Janša’s people took liberties in interpreting what they found in the archives, but few knew just how liberal-an-interpretation they cooked up. Türk apparently knew and it would seem logical for his office to have made inquiries into what exactly were Janša’s people looking for. So, why would the largest opposition party sex documents up in order to substantiate their claims against the president, when they’ve got so much going for them? I mean, SDS is leading the polls, economy is still going down the drain, most people see Janša as the next PM and all he has to do is sit back and enjoy the ride.

Part of it most likely has to do with the fact that Janša will not accept defeat. Danilo Türk’s victory in presidential elections in 2007 was the harbinger of Janša’s electoral defeat a year later. Several of Türk’s moves (not in the least giving a medal to Ertl) were like throwing a gauntlet in Janša’s face. And Türk also stole some much wanted limelight during Slovenian EU presidency, having much more diplomatic clout than Janša and his foreign minister Rupel combined.

Secondly, it has to do with destabilising the country. The largest opposition party seems to have made it its mission to oppose almost every government move and actively try to block and derail any measure which could – even by a long shot – break the current social and economic status quo. This includes calling for referendums virtually on a monthly basis, prolonging the legislative process beyond any acceptable means.

And thirdly, it has to do with creating an atmosphere of distrust, deceit and paralysing fear, where no-one dares do anything for fear of what Janša and his people might dig out on any given person. It is an environment of paranoia Janša thrives in but which is ultimately destructive both to him and the country he wants to lead yet again.

Looks like someone lost their mojo

In short, what was meant to be a sort of political black-ops campaign turned out to be amateur night by people who keep feeding us the same shit over and over again, as if they’re caught in some sort of political Ground-hog day, constantly reliving the same idea over and over, always seeing ghosts and wanting to prove that there is some sort of secret clan of die-hard Communists who run the country, refusing to realise that the entire country is sick and tired of their stale tricks and wants to move forwards. If that is still possible at all.

The more observant of readers will find in there literary gems by none other than former foreign minister Dimitrij Rupel, but even if that’s not your thing, you can still check the crap pengovsky posts against the sharp and deep analysis of the largest opposition party in Slovenia 😀

Pahor-Obama: A Very Special Huddle (But Not All That Special)

So, Big O. met Lil’ B. regardless… Yesterday Prime Minister Borut Pahor concluded his visit the United States. This in itself would be of only mild importance had it not been for the infamous Wikileaks cable detailing how Pahor did some diplomatic tit-for-tat and, among other things, told the top ranking US diplomat in Slovenia that this country will consider taking in one Gitmo detainee, but he’d like to speak to President Barack Obama for 20-or-so minutes. And – somewhat surprisingly – did get what he asked for.

Now, fair’s fair and it should be noted that Gitmo and quality-time with the Big O. were only part of a bigger package, much (if not all) of which was discussed with various US players by Slovene delegation which included foreign minister Samuel Žbogar and finance minister Franci Križanič. The fact that the latter was on the scene suggest that preliminary talks with J.P. Morgan over the bank possibly buying a stake in state-owned Nova Ljubljanska banka may actually yield results. Personally, I wouldn’t hold my breath, although it seems that Slovenian delegation mostly got what it came for: pleading a case for US direct investments, American acknowledgement of Slovenia having clout in the Balkans and some face-time with Obama.

Truth be told, this wasn’t an Oval Office meeting. According to the infamous cable Pahor wanted a 20-minute private pow-wow with the US president, but instead got what appears to be a half-hour group huddle in the Roosevelt Room (adjacent to the Oval Office) where the two leaders were accompanied by their entourage.

Furthermore, it must be said that Pahor is not nearly the first Slovene leader to have met a US president. Way back in 1997 Slovenian President Milan Kučan had a private meeting with president Bill Clinton, which according to reports lasted about half an hour and every Slovene President and/or PM sice was either visiting or hosting the President of the United States of America. A year later Cliton was paid a visit by Slovene PM Janez Drnovšek. Then Clinton came to visit Slovenia in 1999 (co-hosted by PM Drnovšek and President Kučan), then we had the legendary Bush – Putin summit in Slovenia only months before 9/11 with Kučan and Drnovšek again playing co-hosts. A year later Drnovšek meets George W. Bush in the Oval office. Two years later, upon entry into NATO, Bush meets with Slovenian PM Tone Rop, whereas two years after that President Bush meets PM Janez Janša, who – again – two years later, in 2008, together with Slovenian president Danilo Türk plays co-host to President Bush while he visited Slovenia on his farewell tour in 2008. And now, two years later, Slovenian PM Borut Pahor visited US President Barack Obama.

Point being that starting with Clinton, Kučan and Drnovšek US presidents regularly met with Slovenian presidents and prime ministers. In this respect yesterday’s meeting is not really so much of a breakthrough as it is a continuation of Slovenia (again) punching above its weight in terms of regional diplomacy. While Slovenian politicos across the board consider themselves specialists on the Balkans issue, fact of the matter is that the moment the US realised that the endgame of Yugoslav wars will be played in Kosovo and took the Kosovar side, Slovenia was slowly but surely sidelined, although Kučan’s and Drnovše’s advice was much sought before the big boys decided to clear things up and finally kicked Milošević’s ass. Slovenia’s “special status” in the Balkans was of course confirmed by the 1999 Clinton visit.

Under Bush the US focused on their war on terror, life, liberty and pursuit of happiness and since at than time Slovenia was still outside NATO looking in, it continued to curry the US favour, often in a less-than-tasteful form (i.e. by co-signing the Vilnius Letter). Fast forward to 2008 and Slovenia has virtually no more clout in the Balkans (economic expansion into the region notwithstanding). Not that we didn’t have information, insight or opinion, it was just that the border dispute with Croatia was becoming an ever bigger mess, often almost on the brink of a shooting war. And if you can’t solve a petty dispute on your border, how can you give advice in the region? But that was solved, courtesy of big case of cojones on the part of PM Pahor and his Croatian counterpart Jadranka Kosor (with a little arm-twisting from Brussels and Washington) and now Slovenia can have a serious go at regional diplomacy once again. And since it is the US which shuffles this particular deck of cards, Slovenia again has to curry their favour, this time in clearing up the human rights mess that is the Guantanamo Detention Camp. Bottom line: although at times it looked more like Slovenia was blowing American dick and a lot of people looked away in disgust, Slovenia always tried whisper into the Americans’ good ear and for the past twelve years it has more or less succeeded.

Having said that, despite heartwarming assurances that Slovenia is an equal partner and all that jazz, it is obvious that yesterday’s meet-up was not a culmination of a long and successful diplomatic streak but a sort of a re-start, which had some good karma to it. However there are things that were conspicuously missing, mostly the fact that Obama did not meet Pahor separately but sort of “invaded” meeting with VP Biden. However, it is plainly obvious that the whole thing was carefully planned, despite a tweet by foreign minister Samuel Žbogar couple of hours before the meeting asking himself whether or not Obama will drop by.

This has all the hallmarks of a diplomacy Pahor-style, where everyone is playing stupid, allowing everyone to get what they wanted. Something like this happened late in 2009 when Bill Clinton came to a Diners event and bored everyone to death for 45 minutes, but refused to meet with Slovene leadership officially, apparently because the State Department will not have him pissing in his wife’s pool. But Pahor being what he is, he engineered a “chance meeting” in downtown Ljubljana. You can imagine the scene: a former US president just happens to be strolling down Čopova Street and the incumbent Slovenian PM by pure chance happens to find himself on that particular street and you’ll never believe whom he met…

The Pahor-Obama huddle is special when viewed through the prism of the Wikileaks cable which caused plenty of embarrassment and produced some very ballsy denials both in Ljubljana as well as Washington. In terms of defying the public outcry which – although largely unwaranted – followed the release of the cable, the meeting is both an achievement as well as a strong commitment of both Slovenia as well as US. However, when viewed on a larger scale of things, it only shows that what we are seeing is a variation of a familiar tune. A pretty good variation, but nothing radically new.

The Greatest Trick The Devil Ever Pulled…

The above passage from Umberto Eco‘s The Name of The Rose came to mind when pengovsky first heard of the financial hardship the Maribor archdiocese found itself in. And Lord, are we talking hardship. According to an article in Italian L’espresso (in English, surprisingly so), which exposed what until now was only alluded, the archdiocese, which gives guidance to a flock of some 100,000, ran up a debt of some 800 million euro. No, it’s not a mistake. Eight hundred million. That’s more than three times the amount of Slovenia‘s share in Greek bail-out. I won’t bother you with the details, especially since you can read them up in the original article. Suffice it to say that they’ve put all of their eggs in a couple of not very safe baskets and then forgot to watch the baskets. And now they can’t even make an omelette out of broken eggs.

Not that the archdiocese is helping its case. Their official response was full of hypocrisy, false humility and other nouns we’ve come to connect with the Roman Catholic Church. Namely, thev’ve written that they “are aware of their indirect responsibility to shareholders, employees and the public. Our special responsibility goes to people of Catholic faith and all those to whom we were sent to spread the word of Christ and help them in times of hardship. We realise that in the past we have not always made it clear that ours is purely a mission of spreading the faith, education and charity. In the past the Maribor archdiocese has focused on economic matters only to fund and further develop the above pursuits. Our goal was to strengthen our financial positions to better execute our pastoral, educational and cultural activities. These activities are in many countries partly funded by the state. As this is not the case in Slovenia, we tried to establish an economic presence. Today, we realize that this was a wrong decision.

It is highly tempting to go ha-ha (<- click the link, goddammit! 🙂 ) on the Maribor archdiocese (or on the Slovene Roman Catholic Church as a whole), especially since the clergy took virtually every opportunity to bash the Slovenian noveaux riches which have lately been distilled into failed tycoons a la Boško Šrot, Igor Bavčar (remember them?) and lately Bine Kordež of Merkur and Ivan Zidar of SCT. And suddenly, that same organisation, primarily tasked with spreading His word, love for little boys and preventing use of contraceptives turns out to be on the fast track to the fourth circle of hell.

Slightly more than a year ago there was a lot of talk about “exit strategies”. You know, getting back to the business as usual. Back then there were a couple of competing documents, all of which fancied themselves as “exit strategies” and all of them failed to deliver. One of those documents looked beyond the scope of immediately visible and while it didn’t provide answers it pointed out most of the right questions. The problem is that it was outside of the (still) accepted neoliberalistic socio-political discourse and it was quietly forgotten. Everything that followed in its wake were either half-baked compendiums of various semi-useful theories often contradictory in nature and content, badly disguised attempts to totally derail the country and take power by means of early elections or just plain old throwing sand in the wheels of any attempt to fundamentally change the situation. Two of those we can chalk down to Janez Janša‘s SDS, one to labour unions. You figure out who is responsible for what 🙂

Anyways, point being that since any attempt to kick-start things by broadening the spectrum of acceptable was doomed to failure be it from the opposition or the labour unions (plus a little waywardness within the coalition), the breaths of the acceptable became increasingly narrow. This narrowness of course is not something new, but rather became the “accepted norm” of the last thirty years (yes, Slovenes embraced capitalism before we embraced democracy). Soon everyone was expert at everything and those on the bandwagon looked down on those who did not or could not jump on it. And there were mighty few people who didn’t at least attempt the jump. With the power of hindsight it seems perfectly logical that Maribor archdiocese did what it did and that the whole thing went straight to hell but the scope of damage is staggering nevertheless. The total amount of so called “tycoon” credit lines extended to various Slovene companies reportedly amounted to 2 billion euro. Increased by another 800 million, this means that the Roman Catholic Church in Slovenia is responsible for almost 35% percent of all bad debt in this country.

Granted, the Church had realised long ago, even before the dawn of capitalism that money and property mean power. This, after all was also the declared goal of Maribor archdiocese: to promote, evolve and expand the teachings (and with them the influence) of the Roman Catholic Church. But this time it wasn’t just that people who are in the business of faith switched to the business of making (or, rather, losing) money. What we have here is a situation where men of faith put their faith in money. This goes beyond pure attitude one has towards the Church, be it on an ideological or purely personal level. This is probably the final proof that capitalism as we had known it until the fall of 2008 indeed had no real alternative and that in many respects still doesn’t have one, since any alternative which oversteps the boundaries of a neoliberalistic discourse is automatically discarded and – vice versa – every alternative which does not overstep those boundaries is apparently self-destructive.

Generally admonishing the Catholic Church for their ultimate financial fail will get us nowhere, nor will it radically change the playing field. To those who generally are not favouring the Church this is only the latest proof of what was known all along. To the flock, this was probably a shock, but the relation of the faithful to the clergy is theirs to handle. However, rather than dancing on what is arguably soon to become the economic grave of Maribor archdiocese and possibly the entire Roman Catholic Church in Slovenia (it turns out that Ljubljana archdiocese was helping out as well) we should be worried sick. Because if an institution with two-thousand-years-worth of history and collective memory succumbs to the lures of casino capitalism, we can finally get some perspective on just how strong, how deep and how irrational this crisis is.

Two thousand years ago Jesus apparently freaked out and told them that his temple is a house of prayer not a den of thieves. But in this day and age it seems that Keyser Söze was right when he said that the greatest trick Devil ever pulled was convincing the world he didn’t exist. This way, in a world which seemed like financial heaven, you could invest 800 million euro and like *that* it was gone.

So, You Want To Amend The Constitution, Huh?

Lately, talk of amending Slovenian constitution is in vogue, it seems. Janez Janša‘s SDS announced it but failed to give it substance, Gregor Golobič‘s Zares presented their own version and gave it some substance and the government of Borut Pahor as a whole announced it is joining the fun as well. High time for pengovsky to chip as well, so try this on for size:

Abolish the National Council. I mean, what’s with having special interest parliamentary representation in the first place? Sure, it’s nice to hear the voice of all walks of life when passing policy decisions, but there are ways to do it other than creating a second chamber and then amputating it from the start. Fourty-four representatives, all of them elected indirectly is an utterly failed attempt to mix the U.S. Senate with element of corporatism which serves no real purpose but to give give a group of people without a clear mandate the power to call a referendum and generally spend away taxpayer’s money. Cut the crap and create a true single-chamber parliament. Life will be much easier for everyone. After-all it is not as if people sitting in the National Council don’t have enough power as it is through various unions, industrial and commerce chambers and other pressure groups.

Increase number of MPs to 121. Not just because 121 is 11 squared (a nice number, ain’t it), which would make it possible for eleven MPs to be elected in each of the eleven voting units (an increase of three from the existing eight per voting unit). It would also decrease the number of voters per MP, thus increasing the relative representation of the people and – perhaps most importantly – give us an odd number of MPs, preventing the possibility of a 50/50 stalemate in the parliament. And you know how awkward that can be.

Institute a mayor/MP conflict of interest In fact, institute a conflict of interest between serving as an MP and serving as any other elected official, be it on municipal or regional level. Each and every MP represents the entire population of Slovenia. Not just his immediate voting precinct or unit. Mayors who also serve as MPs tend to a) support decisions which are in favour of their municipality and not necessarily in the interest of the entire country and b) have the possibility to indulge in pork-barrel politics, often at the expense of other parts of the country. This simply can not go on. There are municipalities running out of space for new state-funded infrastructure and highway-exits, while others still have problem stuff as basic as sewage.

And don’t forget, you can achieve this also by simply passing the appropriate law.

Amend election rules. This was done before, so it is nothing new, even though you could (as with previous item) get it done by amending the law and not necessarily the constitution itself. Specifically, what is needed is introducing an absolute preferential vote, whereby voters would vote for a specific candidate and thereby vote for candidate’s political party. Should the candidate not receive enough votes to be elected to the parliament, his votes would be added to the votes other candidates of the same party received within the same voting unit and then divided proportionally among those candidates, starting from the top of the list. Technically, this is called “proportional system with strong elements of majority system” and was actually called for by the Constitutional Court. So despite the fact that it is Gregor Golobič’s Zares which advocates this measure (and the one about conflict of interests), it should not be viewed as a party position but as a long-overdue and fundamentally necessary amendment to the constitution.

Create regions Six of them, with Ljubljana having special status as the capital city. True, you’d be creating yet another level of administration, but the advantages are numerous. You can strip the 210-or-so Slovene municipalities of most of their competences and transfer them to regional level. If you want equal access to things like health and education, you can not have municipalities handling it, because most of them don’t have enough money to provide either, let alone maintain their existing infrastructure (unless of course their mayors serve as MPs). This would also enable you to redistribute personal income tax revenue on a much more efficient level. As things stand now this revenue is directed to municipalities’ coffers, which is one of the main incentives for continuous creation of new municipalities (that and the notion that the state will chip in whatever monies the municipality is short on). This of course leads to a lot of municipalities handling minute amounts of cash. Do this on a regional level, however, and suddenly you can actually do stuff with that money. As a side-effect, less money will from central budget and municipalities will suddenly find that they will be better off if they unite rather than split up.

Oh, and why six regions? Because this is the numbers of dioceses of the Roman Catholic Church in Slovenia. People are used to this division. It is also a division which has stood the test of time plus the borders are already drawn. This is probably one of the few good ideas the Catholic Church had in this part of the world, so why not use it?

Simplify the procedure for establishing government As things stand now, the President nominates the candidate for prime minister, who must survive the vote in the parliament. He/she then assembles the cabinet, submits candidates for ministers to a parliamentary hearing process (which has no legal effects whatsoever) and then has to survive the vote again in order to have a fully empowered government. This is bullshit. It was fun while Slovenia still had the assembly system (three-chamber parliament, a delegate system without freedom of vote, the works), but in a liberal democracy things just don’t work well that way. First of all, why should the PM go through the same procedure twice in as many weeks? Why should it take two or more weeks to establish a government anyhow? And why shouldn’t the PM be able to fire ministers on the spot? He/she can’t do it under the existing system. Since the parliament appointed the minister it is only the parliament who can dismiss him/her, effectively tying the PM’s hands and possibly putting him in the position of having to work with an uncooperative minister. It has happened, you know.

If there is a clear parliamentary majority (which would always be at hand if we had an odd number of MPs), there really is no need for such a prolonged process. The power to nominate the candidate for PM would still be with the President and after the parliament appointed the prime minister he/she would simply assemble his cabinet and send the list to the president for approval. And if you really need a safeguard, you can empower the Prez do refuse the cabinet list, at which point the PM-in-waiting would have to ask the parliament to vote on his cabinet. The same would apply for dismissal of a particular minister. Or, if you want the really effective version, you can leave the power to appoint and dismiss ministers solely with the PM, once he is appointed by the parliament. In any case, you have a much more effective government and a much stronger leadership role by the PM. And most importantly, the loyalties of individual ministers can no longer be torn between the government in which they serve and the parliament this appointed them.

Don’t mess with referendum. Just because the opposition fucked you with referendum bids a couple of times, this doesn’t mean that you can go about limiting who can call a referendum. OK, so it might be prudent to increase the number of signatures needed to start the referendum bid in the first place, but you don’t have to change a constitution to achieve that. Always remember that the point of the referendum is to check moves and motives of an excessively autocratic government (or parliamentary majority).

The fact that referendum provisions are being abused to block legitimate policies on a daily basis is not a legal question but rather a question of political manners. Because as long as no punches are being pulled as long as playing hard-ball is the norm rather than the exception and as long as any end will justify any means, so long will legislation and rules and procedures continue to be abused to derail policy agendas just for the fun of it. There is no way you can limit the system of checks and balances in a manner that will be both democratic and prevent abuse. You just can’t do it. It simply isn’t possible.

And should you by any chance manage to institute such limitations, trust me, they will come to haunt you faster than you can say “election defeat” (if you catch my meaning).

This, basically, is it. Anything beyond the above will either result in fundamental restructuring of the republic or will simply be yet another abuse of democratic mechanism aimed at paving the way to power without presenting anything close to a viable political platform.

And this is the gist of it, methinks. What this country needs is not some sort of a new social contract or (God forbid) a Second Republic, but rather a common awareness among political players that destructive behaviour will only increase the amount of shit we all will have to deal with. Fact of the matter is that lately nothing is sacred any more. Even the legislative procedure is abused in order to facilitate a desired outcome, case in point being the last events on establishing municipality of Ankaran (more on that some other time). The problems this country is facing are real and institutional changes can only take you so far. Especially if you play around with the constitution, which is suppose to stand the test of time rather than be changed according to daily (political) needs.

Referendum On The Law On Menial Work: A Case Of Assisted Suicide

As of yesterday the Student organisation of Slovenia is collecting 40 000 signatures needed to hold a referendum on the recently passed Law on Menial Work. Yes, another referendum is looming, the second in as many months and god-knows-which in the entire history of this country. This is the same law that sent students (and pupils) to streets on 19 May last year and produced the final proof that on the whole they are a bunch of irresponsible brats who generally can’t tell their ass-hole from from their ear-hole. Case in point being the said referendum which is a) un-fucking-believable and b) stupid.

Starting with a) I’m amazed at how leaders of the student organisation have the balls to do anything but sit quietly in the corner and do as they’re told. I mean, whatever clout they had with the “grown-up” politics and the general public, they’ve lost it last May as far as I’m concerned. There you have an organisation and its various branches and dependencies with combined yearly budgets of about 16 million euro (no, it’s not a mistake), there’s no real oversight and almost zero consequences in case of any wrongdoing. But then a demo goes bad and rather than trying to contain the situation they split the scene and blame everyone else. So much for responsibility and cojones. And yet, once the dust is settled and miraculously no one is even forced to resign (let alone charged with endangering public safety or something like that) those very same people go for a referendum? What is this? Some kind of a Vaudeville act?

But it does not stop there. Not only is this latest referendum bid (while perfectly legal) very dicey from an ethical point of view. It is also b) one of the more shining examples of shooting oneself in the knee we’ve witnessed in the past year or so. And with that in mind it is little wonder that the student organisation enlisted help of labour unions. Hey, why fuck yourself when you can get ass-rammed by others and be treated to a dirty sanchez.

Namely: The law on menial work (malo delo, link in Slovene only) will largely overhaul student work in Slovenia which has in recent years become more or less the only form of employing young people, especially in the private sector. The problem, which soon became common to tens of thousands of young people was, that despite having worked more or less full time for years on end, this did not officially count as experience, nor did it add towards their retirement age. Since the state paid for student’s social security, the pension fund was none better off and therefore student officially had zero years of working experience. And since most companies required at lest a couple of years’ experience even for entry-level jobs, you can see where this leads to: one big vicious circle, where young people can’t get a job, as a result can’t get regular income, as a result of that they can’t get a loan with the bank and are thus unable to gain any firm footing of their own, creating the unhealthy environment of ever longer stays at mama-hotels.

That labour unions are assisting the student organisation in their self-destructive enterprise is a deviously Machiavellian act which is aimed at maintaining the status quo, i.e.: keeping the students at bay, obstructing their entry into the real labour market as much as possible. In other words – while the student organisation is committing suicide on the students’ behalf, the labour unions are happily assisting. Though it may seem otherwise, students have no representative in this is debate. The only one who possibly cares for their interest is the government with this law, but one shouldn’t be fooled into thinking that this is some kind of random act of human kindness. The law is a necessary element of shaking up the labour market and benefits it brings to the students are only a side-product of a larger enterprise.

What we have here is a situation where labour unions have long stopped representing “class interest” and are now only representatives of an ever-thinning group of people who want to retire as soon as possible, not caring about successive generations. Student organisations are also keen on keeping the status quo, primarily to maintain a cosy source of financing via “student agencies”, employment agencies dedicated exclusively to students, where they took a cut from every student’s income for “providing him/her with work”. If anyone is creating added value in this country, it is the high-skilled low-wage workforce (mostly students) but they are cannot expect any mid- or long-term rewards, thus only exasperating the problem of ever worse social security. But no one is speaking on their behalf, although everyone pretends to.

This is not an ideal law. Should it be enacted, the students will face increased job competition, because the unemployed and pensioners will compete for jobs previously held exclusively by students. However, the upside is that now the time spent working will count towards everyone’s pensions and work experience, students included. Furthermore, there will be no need to artificially extend student status (as was the accepted practice for the last twenty years) in order to be able to get work through “student agencies”, thus possibly radically reducing the amount of time people spend at the university. Right now it takes people seven-to-eight years on average to graduate in what is usually a four-to-five-year course.

So in general, students will be better of in mid- and long-term while they will quite probably be able to compensate short-term drawbacks by being better educated and more flexible than the competition of unemployed 45-year-olds or retired 65-year-olds, not to mention the fact that students probably wouldn’t touch the old farts’ jobs with a ten-foot pole in the first place.

The Mother Of All Referendums (Slovenia Twenty Years After)

Twenty years ago on this day Slovenes voted on a referendum on independence. The question on 23 December 1990 was straightforward: Should Slovenia become a sovereign and independent country. The decision, as we know, was also fairly straightforward. With record voter turnout (93,5%) as much as 88,5% of all voters voted in favour on what will turn out to be the mother of all Slovenian referendum.

Twenty years later the situation seems all but hopeless. The crisis is in full swing, politics and politicians have virtually no credibility left and referendums are a-dime-a-dozen. In the words of the Charlie Watts quartet: You can’t always get what you want.

But really, is it that bad? On one hand, yes. I’m sure people would vote “no” in 1990 if the question would be something along the lines of “Do you want Slovenia to become a country of ever increasing social inequality, political bickering and a seemingly endless supply of either real or perceived scandals and corruption)”.

On the other hand, things are not that bad. I mean, they’re not that bad if one looks at them from the standpoint of 1990s. The issues we are faced with today are nothing compared to the issues Slovenia was facing back then. Twenty years ago it was about survival. It was about whether the nation can make a right choice collectively and hoping that this choice will be proven to have been right some time in the distant future. Today we can, regardless of the despair and dejectedness a lot of people are facing, say that the choice was right. And although – with the power of hindsight – it looks today that it was the only logical choice, that was not the case. It could all have ended very very badly. But it didn’t. Thankfully.

Anniversaries are a welcome interruption to our daily routine and they often remind us that there are issues bigger than our daily problems. That anniversaries are often used or misused to promote a particular political goal is regretful but no-one will get killed over it. That myths are being constructed is also just a sad fact. That Slovenia will today witness not one, but two celebrations – one official organised by the governement of Borut Pahor, the other one organised by Janez Janša and people who claim they represent “the true values” of Slovene independence is a curious fact which serves some immediate political purpose of the opposition, but nothing beyond that.

Because (as the good doctor often says), what everyone keeps forgetting is that there would be no independence without the people of this country, who bit the bullet and leapt into the unknown. That a selected group of individuals today claims exclusive rights to interpretation of events around 23 December 2010 is demeaning to this nation.

Independence today is what we make of it, for better or for worse. Reminding us “what it was all about” helps, but only to the point where it saves us from making the same mistake over and over. Anything beyond that is counter-productive. And there seems to be a lot of that going around lately. And in times of crisis one shuns what is not helpful 😀

One More For The Road

Q: How much must a Slovene drink to score .25 on a breathalyzer test? A: Nothing for at least three days.

Minister for local self-government and regional policy Henrik Gjerkeš resigned yesterday after being taken into custody by the police for driving under the influence at 4 AM on Tuesday whilst returning home from ministry’s end-of-the-year party. Apparently he scored .63 on breathalyzer test, which is not at all surprising if one takes into account the fact that the party apparently started at 2 PM on Monday. While it is not known whether Gjerkeš was there for the entire fourteen hours, one can imagine that he did put some back into it. Especially given the fact that he was pulled over for driving on a motorway with a flat tyre. Oh, and he was driving a government Audi :mrgreen:

Obviously, Gjerkeš had no choice but to resign immediately, putting additional strain on an already embattled government of Borut Pahor. That quick resignation minimised the media and political fallout is a no-brainer, but it has started a chain of events which will further drain energy and resources of the government in general and the prime minister in particular.

Techincally, Gjerkeš was appointed by the parliament and it is the parliament who will a) have to note his resignation and b) appoint his successor. This will apparently be Duša Trobec Bučan who until now served as state secretary in Gjerkeš’s ministry and was his right-hand woman. The mechanics of the transfer are relatively straightforward, doubly so given the fact this is in fact a ministerial position without portfolio and that the Ministry for local self-government is in fact a government office, elevated to ministry status on a per-government basis.

However, the new would-be minister will first have to attend a parliamentary hearing in front of appropriate committees and then she and PM Pahor will have to go though a special session of the parliament where you can be sure no punches will be pulled. Doubly so because this ministry is in charge of acquiring EU cohesion funds and the sight of €€€ being pumped into his/her constituency makes many an MP go rabid. Doubly so if they also serve as mayors in their respective municipalities.

Gjerkeš’s resignation might seem normal and the only decent thing to do – and it is – but the sad truth is that it does set new standards in Slovenian politics, since there are well documented cases of MPs driving under the influence and even causing accidents and yet they not only got away with it, they even got re-elected. Pengovsky knows of one other case years when a minister caused a traffic accident (no one was hurt) and not only did he get away with it, he even managed to put a lid on it and the media didn’t report it. He later bragged about it to pengovsky during (the irony) one of many end-of-the-year receptions.

Bottom line: this was a totally stupid mistake to make on Gjerkeš’s part. Especially since he turned out to be quite capable, regardless of his virtual anonymity before becoming minister. As it is, he is now only a statistic – the sixth minister PM Pahor will have to replace, the second in this particular office.
